ISLAMABAD: Chief Justice of Pakistan Iftikhar Muhammad Chaudhry said on Wednesday that all the agencies of the country were doing things that were not in their mandate.
Hearing Air Marshal ® Asghar Khan's petition regarding distribution of funds by ISI among politicians in 1990 elections, the chief justice said, "This country belongs to all of us and contrary to what some quarters think it is our responsibility to protect it." A three-member bench of the apex court, headed by the CJP himself, drew the attention of Attorney General of Pakistan (AGP) Maulvi Anwarul Haq towards a news item published in an English daily on March 14 that claimed the ruling Pakistan People's Party withdrew Rs 270 million from the secret fund of the Intelligence Bureau (IB) to push its agenda in Punjab in 2009.
The AGP read out the news item in the court and stated that he had no instructions or knowledge about its authenticity, and would inquire about its veracity. The court also issued notice to publishers, printers and reporters of the newspaper to assist it by providing classified documents before the next hearing. The CJP asked Asghar Khan's counsel, Salman Akram Raja, to file a petition regarding the alleged distribution of money by the IB.
The AGP informed the court that he had examined the in-camera statements of Gen ® Naseerullah Babar and Gen ® Asad Durrani, and had no objection if the statements were declassified, as all the relevant facts in the documents were in public or public domain. He sought time from the court for making the inquiry reports of Habib and Mehran Bank public, saying that the law secretary did not have the reports, while the interior secretary was out of the country, and he would check with him when he retuned. Akram Raja argued it was the federal government's responsibility to procure these documents, and noted that Interior Minister Rehman Malik had stated two days ago that he had lot of documents regarding the case, which he would submit in the court if summoned.
Younas Habib, who had submitted an affidavit in the court on March 8 in response to those submitted by Gen Aslam Beg and Gen Durrani, stressed that he did so with all sincerity, honesty and in order to bring the truth on record, and there is no question of scandalising the highest court of the country. He stated from the filing of the petition by Asghar Khan until the time he submitted the affidavit, he never met any political figure. "Only General Mirza Aslam Beg spoke to me in the last two years, only four to five times," he claimed.
"I have no interest in the politics of the country and can never think of maligning any person and obstructing the course of justice. The photo submitted by me in the affidavit is the proof that the former president Ghulam Ishaq Khan and Gen ® Aslam Beg pampered me to the extent that I could not refuse to their orders. I took out Rs 1,480 million from Habib Bank Ltd, and not Rs 1,800, as stated by General ® Aslam Beg," he professed. The CJP ordered him to avoid giving interviews to TV channels. The hearing of the case has been adjourned until March 30.

All the worlds spy agencies work beyond their mandate .Nothing unusual in that.

Well to be honest.
I would expect pakistans spy agencies to work beyond the remit of any political or judicial authority. But I do nt expect Pakistani citizens to disappear or be tortured by these people. I expect them to do what is necessary and reeducate these people through programmes designed to reintegrate these miscreants back into society as good people. It is possible. After all Pakistani spy agencies are there to defend Pakistan and it's people and not to deliver extra judicial sentences.

Good ..... Pakistan's Spy Agencies ought to be working beyond their mandate, given the utterly corrupt, traitorous and criminal politicians that infest our country. I say, take it a step further and regulate PEMRA as well, that has a dismal and pathetic record on not banning hindustani channels in Pakistan.

For instance, this kind of news don't get highlighted in the socalled free and modern Pakistani media:
I was just watching Madani Channel coincidently when they showed the conference Dawat-e-Islami attended and held speeches infront Chief Justice and jugdes from all Supreme Courts of Pakistan.
My duaa is that the jugdes become steady and strong against the tyrant politicians, rulers and corrupt idiots acting like Pakistan is their own shop!!!

Funny how Aitezaz Ahsan pleads Article 10 of Constitution and asks that judges in the bench should be replaced and Zardari should be given his fundamental right of free and fair trial. I wonder if any attorney ever pleaded the same article for these people. Well, the issue is not as simple as it appears to be. All agencies nab people and work beyond their mandates, nothing new in it. The problem is that in Pakistan the missing personnel are not given their chance to be tried by courts of law and one should not wonder when you see the corrupt judiciary we have. The whole system needs an overhaul. Judges do get threats and and they too get easily afraid while giving verdicts in such cases. It is for this reason that for more than ten years no person indicted of serious crimes against country and people were convicted by courts of law and if at all they were, the punishments were nominal as compared to the crimes. The credit also goes to our defective evidence law which for sure need to be brough in line with the changing scenario. Not to forget, amendments in procedural law will be one way to provide relief to judges who have emotions and who love their families and their own lives (for example by keeping such proceedings and names of judges and prosecutors secret for a time period etc). Changes in evidence law will prove handy in making the military believe that not everyone will be acquitted by the court and perhaps the nabbed ones would get a chance to a free and fair trial.
