Act on orders by Sep 5, LHC to Zardari

LAHORE: The Lahore High Court (LHC) has set a deadline of September 5 for President Asif Ali Zardari to stop political activity while sitting in the Presidency.

Earlier on Wednesday, the LHC had given President Zardari ‘one more chance’ to comply with the court’s order adding that if this was not done contempt proceedings would be initiated.

A three member bench of the LHC headed by Chief Justice Umar Ata Bandial completed proceedings on petitions relating to contempt of court being committed by President Zardari by not giving up his political activities in the President House.

On May 12 last year, a full bench of the LHC ordered that President Zardari could not continue as co-chairman of the ruling Pakistan People’s Party, while sitting in the presidency.

The full bench had asked President Zardari to either step down as co-chairman of the PPP or stop using the presidency for politicking.

Yes, if this is against the law I fully agree with the judges that President Asif Ali Zardari should give up his political activity and resign from the Co-Chairmanship post of Pakistan People's Party if he continues to assume presidency.

President Asif Ali Zardari came to power as the Democratically Elected President of Pakistan on September 9, 2008.  Why has no judge or a political party said anything in this regard for the past nearly 4 years?

When the National Assembly of Pakistan voted President Asif Ali Zardari into power, were the judges not aware of the President also holding the position of Co-Chairmanship post since December 30, 2007?

NAUDERO: Newly appointed Pakistan People’s Party (PPP) co-chairman and husband of assassinated former premier Benazir Bhutto, Asif Ali Zardari said on Sunday that the PPP wants to contest the general elections on January 8.

In a press conference in Naudero, he called on Pakistan Muslim League-Nawaz (PML-N) chief Nawaz Sharif not to boycott the polls. “We are thankful to the PML-N for announcing to boycott the elections but we ask them to end the boycott and contest the elections, so as not to leave the field open for the PML-Quaid-e-Azam (PML-Q),” Zardari said.

The decision to participate in the polls was made earlier in a closed-door meeting of the party’s central executive committee (CEC). Party officials told reporters that Benazir’s 19-year-old son, Bilawal Bhutto Zardari, had been appointed the new PPP chairman. “It has been decided that Bilawal will be the chairman and Mr Zardari will be co-chairman,” a party official said.

Successor in will: PPP Vice Chairman Makhdoom Amin Fahim said Benazir had named Zardari as her successor in her will, adding that since Zardari had excused himself, Bilawal was named chairman following the party’s CEC meeting.

He said he was not contesting the polls and would not become the prime minister if the PPP won. He said Benazir had nominated Fahim for the position, adding that the party would now make any decision concerning this.

When asked to show Benazir’s handwritten will, Zardari refused, saying members of the CEC had read it and acknowledged it to be Benazir’s handwriting.

Party ‘caretaker’: Bilawal Zardari, a student with no experience in politics, said he would remain at Oxford University, leaving his father, Asif Ali Zardari, as the effective leader of the country’s largest political party, reported AP.

“The party’s long struggle for democracy will continue with renewed vigour,” Bilawal told a news conference. “My mother always said democracy is the best revenge.”

Bilawal said that Zardari would “take care” of the party while he continued his studies.

Zardari said Benazir’s sister, Sanam Bhutto, “was consulted before the final approval of Bilawal’s chairmanship”.

Zardari said he had seen the wound on Benazir’s neck, which was clearly the wound caused by a bullet. Whatever the government has said about the reason for her death is baseless, he said. He added that he had denied the Pakistani government permission to conduct an autopsy, saying he had lived in the country “long enough to know” how it would have been handled.

“I was with her the first time she took the prime ministerial oath,” Zardari said. She had said, “I have taken the revenge of my father.” The time has now come to revenge the killing of Benazir, he said.

“I appeal to all people to vote for PPP candidates and teach the PML-Q a lesson,” Zardari said. He added that his party’s struggle was not against the country’s military but against those who were playing negative politics.

Zardari takes oath as President: ‘President will be subservient to parliament’

ISLAMABAD: Asif Ali Zardari was sworn in as Pakistan’s president on Tuesday, and immediately pledged subservience to parliament.

“The president will only carry forward the brief of the government and bow before the parliament,” he said while addressing his first press conference after taking oath as president. But he parried direct questions on the abolishment of the 17th Amendment.

Musharraf: To another question, Zardari said the parliament would decide whether former president General ® Pervez Musharraf would be given an indemnity from any prosecution.

He said he would continue his policy of reconciliation. “We do not seek revenge. We forgive and move forward and our message is of reconciliation.” Asked if he would reinstate all the sacked judges, he said he had no grudge against any of them.

Kashmir: The new president said Pakistanis would hear ‘good news’ about the Kashmir dispute with India soon.

“[Because of] back-channel diplomacy, there will be good news before the Congress-led government in India goes for the election [next year],” he said.

Zardari said he had the support of the Pakistan Muslim League-Nawaz (PML-N) on Kashmir and referred to a bipartisan committee that will devise a joint policy on the issue.

Zardari said he would take up the issue of a United Nations-led probe into Benazir Bhutto’s killing during his visit to the UN headquarters for an annual General Assembly meeting. “I will ask the UN as [a] victim of terror, and hopefully we will get to the bottom of it,” he said.

To a question, the president said he was planning a visit to China – his first foreign tour – but refused to go into details of what he would discuss with the country.

He said the government would implement the Iran-Pakistan-India gas pipeline project and would develop other means to resolve the energy crisis and inflation.

Zardari said food inflation was related to a shortage, and that the government would increase the price of wheat at the time of sowing next year to tackle hoarding and smuggling.

Earlier, Chief Justice Abdul Hamid Dogar administered oath to the new president in a ceremony broadcast live.

Afghan President Hamid Karzai joined top Pakistani officials, military top brass, judges, diplomats and high-ranking civil servants at the ceremony, which ended with Zardari receiving a military honour guard.

Nawaz congratulates Zardari on Presidential success


ISLAMABAD: The head of PML-N, Mian Nawaz Sharif has congratulated Asif Ali Zardari upon his election as President of Pakistan.
Mian Sahib has been known to telephoned the PPPP co-chairman to congratulate him over his success, and assured his (Nawaz Sharif’s) support for Zardari and democracy.

Mian Sahib expressed his hopes that Asif Ali Zardari would eschew political affiliations and take all along the political mainstream of the Country.

Asif Ali Zardari thanked Mian Nawaz Sharif for his kindness, and cordially invited him to attend the Presidential oath taking ceremony.
Mian Nawaz Sharif has been known to have accepted the invitation and has even cancelled his forthcoming London visit until Tuesday.

Zardari will not go to Jail, he will go into self imposed exile like Musharraf never to come back.

The only thing that has some chance of coming back to Pakistan will be the money he looted.

In early 2009, his attempt to prevent the reinstatement of Supreme Court judges failed in the face of massive protests led by Nawaz Sharif, his chief political rival. The passage of the 18th Amendment in 2010 reduced his vast presidential powers to that of a ceremonial figurehead.

A major report was published in January 1998 by The New York Times detailing Zardari's vast corruption and misuse of public funds. [32] The report discussed $200 million in kickbacks to Zardari and a Pakistani partner for a $4 billion contract with French military contractor Dassault Aviation, in a deal that fell apart only when the Bhutto government was dismissed. [32]

It contained details of two payments of $5 million each by a gold bullion dealer in return for a monopoly on gold imports. [32] It had information from Pakistani investigators that the Bhutto family had allegedly accrued more than $1.5 billion in illicit profits through kickbacks in virtually every sphere of government activity. [32] It also reported Zardari's mid-1990s spending spree, which included hundreds of thousands of dollars spent on jewellery. [32] The arrangements made by the Bhutto family for their wealth relied on Western property companies, Western lawyers, and a network of Western friends. [32]

The report described how Zardari had arranged secret contracts, painstaking negotiations, and the dismissal of anyone who objected to his dealings. [32]

Citibank, already under fire for its private-banking practices, got into further trouble as a result of the report. [33] Zardari's financial history was one case study in a 1999 U.S. Senate report on vulnerabilities in banking procedures. [34]

Second imprisonment and conviction

In March 1997, Zardari was elected to the Senate while in a Karachi jail. [35][36] In December 1997, he was flown to Islamabad under tight security to take his oath. [35]

In July 1998, he was indicted for corruption in Pakistan after the Swiss government handed over documents to Pakistani authorities relating to money laundering. [37] The Swiss had also indicted him for money laundering. [37] At the same time, in a separate case, he and 18 others were indicted for conspiracy to murder Murtaza Bhutto. [38] After criminal prosecutions began, Citibank closed Zardari's account. [33]

In April 1999, Bhutto and Zardari were convicted for receiving indemnities from a Swiss goods inspection company that was hired to end corruption in the collection of customs duties. [39] The couple received a fine of $8.6 million. [39][40] Both were also sentenced to five years imprisonment, but Bhutto could not be extradited back to Pakistan from her self-imposed exile. [39][40] Zardari was already in jail awaiting trial on separate charges. [39][40] The evidence used against them had been gathered by Swiss investigators and the Pakistani Bureau of Accountability. [39][41]


In May 1999, he was hospitalised after an alleged attempted suicide. [42] He claimed it was a murder attempt by the police. [42]

In August 2003, a Swiss judge convicted Bhutto and Zardari of money laundering and sentenced them to six months imprisonment and a fine of $50,000. [43] In addition, they were required to return $11 million to the Pakistani government. [43] The conviction involved charges relating to kickbacks from two Swiss firms in exchange for customs fraud. [44] In France, Poland, and Switzerland, the couple faced additional allegations. [45]

In November 2004, he was released on bail by court order. [46][47][48] A month later, he was unexpectedly arrested for failing to show up for a hearing on a murder case in Islamabad. [46][47][48] He was placed under house arrest in Karachi. [46][48] A day later, he was released on $5,000 bail. [46][47] His release, rearrest, and then release again was regarded as a sign of growing reconciliation between Musharraf's government and the PPP. [46][47] After his second release in late 2004, he left for exile in Dubai. [6][49]

Exile and legal problems

He returned to Lahore in April 2005. [49][50][51] Police prevented him from holding rallies by escorting him from the airport to his home. [49][50][51] He criticised Musharraf's government, but rumours of reconciliation between Musharraf and the PPP grew. [50][51] Zardari went back to Dubai in May 2005. [52][53]

In June 2005, he suffered a heart attack and was treated in the United Arab Emirates. [52][53] A PPP spokesman stated he underwent angioplasty in the United States. [53] In September 2005, he did not show up for a Rawalpindi hearing on corruption charges; the court issued an arrest warrant. [53] His lawyers stated he could not come because he was recovering from his treatment. [53] Following a request by the Rawalpindi court, Interpol issued a red notice in January 2006 against the couple which called on member nations to decide on the couple's extradition. [54][55]

When Bhutto announced in September 2007 her upcoming return to Pakistan, her husband was in New York City undergoing medical treatment. [56] After the October 2007 bombing in Karachi that tainted Bhutto's return, he accused Pakistani intelligence services of being behind the attacks and claimed "it was not done by militants". [57][58] He had not accompanied Bhutto, staying in Dubai with their daughters. Bhutto called for the removal of the chief investigator of the attacks because she claimed he had been involved in Zardari's alleged torture in prison in 1999. [59]

In November 2007, Musharraf instituted emergency rule for six weeks (see Pakistani state of emergency, 2007), [60] under the pretext of rising Islamist militancy, a few days after Bhutto's departure for Dubai to meet with Zardari. [61][62] Immediately after the state of emergency was invoked, Bhutto returned to Pakistan, while Zardari again stayed behind in Dubai. [61][63]

Emergency rule was initiated right before the Supreme Court of Pakistan began deliberations on the legality of Musharraf's U.S.-backed proposal—the National Reconciliation Ordinance (NRO)—to drop corruption charges against Bhutto and Zardari in return for a joint Bhutto-Musharraf coalition to govern Pakistan. [61][62]

Bhutto and Zardari sympathised with Musharraf on his feud with the Supreme Court, but simultaneously criticised the imposition of martial law. [61][62][63]

Before the Supreme Court could issue a decision, Musharraf replaced its members with his supporters. [61][62]

In the midst of his exile, Zardari had several different legal problems. In Pakistan, Musharraf granted him amnesty for his alleged offences through the National Reconciliation Ordinance, drafted in October 2007. [44]

However, the ordinance faced mounting public pressure and an uncompromising judiciary. [44] In addition, it only dealt with charges up to 1999. [44] This left open the possibility of investigations into his alleged involvement in about $2 million in illegal kickbacks to Saddam Hussein, discovered in October 2005, under the oil-for-food program. [44] If the ordinance was rescinded, he would have had to deal with charges relating to evading duties on an armoured BMW, commissions from a Polish tractor manufacturer, and a kickback from a gold bullion dealer. [44] In Switzerland, Bhutto and Zardari appealed the 2003 Swiss conviction, which required the reopening of the case in October 2007. [44] In November 2007, Swiss authorities returned the frozen $60 million to him through offshore companies because of the National Reconciliation Ordinance. [64]

In Spain, a criminal investigation was opened over the money laundering for the oil-for-food program because of the illicit profits handled through Spanish firms. [44] In Britain, he was fighting a civil case against the Pakistani government for the proceeds from the liquidation sale of a Surrey mansion. [44] He successfully used his medical diagnosis to postpone a verdict on his British manor trial. [65][66][67]

In exile, he shifted between homes in New York, London, and Dubai, where his three children lived. [6]

On the night of 27 December 2007, he returned to Pakistan following his wife's assassination.

You have to look at how British Law works (though I myself is not a fan of if but it is the one implemented in Pakistan). unless you file a case against someone, the courts cannot rule for/against them.
